Student on trial after she allegedly forced sex without his consent

A student who is on trial for allegedly forcing a man to have sex without his consent allegedly told the complainant that “you may be saying no, but your d*** is saying yes”, a court has been told.

Southampton Crown Court heard that Imogen Brooke, 30, left a “non-consensual” love bite on the man that appeared as if she had “strangled” him.

During the alleged incident at her home in Southampton, Hampshire, Ms Brooke was described as “in the mood” and “very drunk”.

The court heard that the protests of her alleged victim went “in one ear and out the other”, leaving the man feeling “violated”.

Ms Brooke allegedly “pinned” the man down, weighing considerably more than him at 24 stone.

Miss Brooke denies that she caused a person to engage in sexual activity without consent.

Prosecuting, Robert Bryan said the defendant “caused her victim to engage in sexual activity, and he did not consent, and she did not reasonably believe him to be consenting”.

He told the court that “misconceptions” surround the idea that “a sexual offender is male and the victim of a sexual offence is female”.

He said that “stereotypes have no place in criminal court”, adding that “physical arousal is wholly separate to consent”.

Mr Bryan continued: “She climbed on top of him and pulled his boxer shorts down.

“He told the police investigators she is quite a lot bigger and stronger than him and he couldn’t move her. He wanted it to stop.”

The complainant said the incident likely lasted around 15 minutes but felt “never-ending”.

The court was told Ms Brooke had taken a photograph of the man while he was asleep, before sending it directly to her alleged victim the following morning.

The complainant testified remotely to the court, saying he “can’t get it out of my head” and that he recalls “the entire night”.

The photograph was said to spark “flashbacks of a fairly horrific incident”.

He said via video link: “I found it difficult to sleep that morning. It took quite a while.

“I stared at the wall most of the night after she forced me to have sex.”

He added: “I found a photo of me – of me asleep and a bruise on my neck. The bruise was from [Miss Brooke].”

“The mark to my neck came during the incident that took place in those early hours.

“She was biting my neck.

“It took place while she was on top of me, when she had me pinned on my back, she was biting my neck at the same time.”

The trial continues.
