From April, all frontline NHS workers will need to be vaccinated against Covid in order to keep their jobs. The Government decision has led many to question whether employers should be allowed to mandate vaccination.
—————–
According to Laura Kearsley at Nelsons law firm, an employer can introduce clauses in contracts of employment that require their workforce to be fully vaccinated.
They can do this because all businesses have a legal duty to provide their employees with a safe working environment.
Ms Kearsley writes: “Should an employer introduce measures that require workers to be fully vaccinated and an employee still refuses, depending on the circumstances, it could result in the employee being redeployed to a different role or they could be dismissed.”
Major companies that have mandated vaccines for some or all of their workforce include: Twitter, Uber, McDonald’s, The Walt Disney Company, The New York Times, Morgan Stanley, Microsoft, Google, Facebook and American Express.
Netflix have even mandated vaccination for key cast and crew on US TV and film productions.
In a poll of 2,093 Express.co.uk readers, held from December 10 to 13, 71 percent said people should not be asked to include their vaccination status on their CV, while 29 percent said they should.
Express.co.uk reader Paul J said: “Disgusting that employers should discriminate in this manner. I’m an employer, I wouldn’t even consider it.”
Olly Smyth replied: “Well done you. This erosion of our freedoms is very dangerous.”
John Moreland agreed: “Vaccination is your choice, and it has nothing to do with your employer. Your body your choice.”
But others felt enraged by their responses.
A reader, going by ‘Unilateral’, responded to Paul J, saying: “I hope you do not run a care home.”
Another read, nicknamed ‘Ex Lancs Lad’ agreed: “It’s your employer’s choice to employ you if you are vaccinated, time to stand up for the people in care homes, not those selfish anti-vaxxers.”
Nurse Sue said: “Bring on vax passport and rid restaurants of the unvaccinated.”
Since November 11, all care home workers needed to be double jabbed by law because they work with the most vulnerable elderly in society.
The Prime Minister announced on Wednesday a “national conversation” would need to be held on how to address the issue of Britons refusing vaccination.
During the briefing, the Prime Minister said he did not want Britain to be a “society and a culture where we force people to get vaccinated”, adding: “I don’t think that’s ever been the way we do things in this country.”

But he went on to say that, if vaccines are shown to be capable of “holding” Omicron, “there is going to come a point” when “we are going to have to have a conversation about ways in which we deal with this pandemic”.
He said: “I don’t believe we can keep going indefinitely with non-pharmaceutical interventions, restrictions on people’s way of life, just because a substantial proportion of the population still, sadly, has not got vaccinated.”
The Omicron variant is now posing a major threat to the UK and risks overwhelming the NHS significantly as cases double in just two days.
Covid is able to mutate more easily in unvaccinated bodies, according to Chief Medical Officer Chris Whitty, which is why the Government has called on every citizen to get their first, second, or booster vaccine.
All adults are now able to book their Covid vaccine through the NHS, and visit walk-in centres for a same-day vaccination.
