Man returned to date after 'fatally shooting fake parking attendant over $40'

A man allegedly shot a fake parking attendant over $40 and then returned to his dinner date.

Erick Aguirre, 29, paid $40 to park and found out when he was inside a burger joint that he was scammed. Aguirre is accused of going back outside to the man posing as a parking attendant, Elliot Nix, 46, and shooting him to death.

Aguirre then returned to his date and told her ‘everything was fine’, court records state. He told her that he merely scared the man outside the Rodeo Goat restaurant in Houston.

The couple began walking to a table but left as Aguirre appeared uncomfortable, according to the records.

Two days later, Aguirre’s date reached out to cops, who were hunting for them and had released their photos.

‘She wanted to do the right thing,’ her lawyer Rick DeToto told KPRC. ‘She wanted to make sure that she came forward and told the police what she knew.’

Nix approached the couple as they parked their cars close to the restaurant in the downtown. Nix told them it would cost $20 each, and Aguirre paid the total, a probable cause affidavit states. A restaurant worker later told them that Nix was not a parking lot worker.

Aguirre was spotted by a smoke shop worker going to his car, taking out a gun and going after Nix. They disappeared, but the worker said he heard a gunshot just before 8pm. Afterward, the worker saw Aguirre ‘nonchalantly walking back to his car with the gun in his hand’, according to the affidavit. Aguirre put the gun back in his car and headed back to the burger spot.

Meanwhile, Nix was transported to a hospital, where he succumbed to the injuries.
