Brexiteer turns on Gina Miller in explosive Brexit clash – ‘You’re patronising’

Gina Miller last week warned she has now assembled a team to legally challenge the next Prime Minister over potential attempts to keep MPs from retaking their seats and intervene to prevent a no deal Brexit. Ms Miller won a High Court case against the Government over the involvement of Parliament in Brexit in 2017. As she discussed her fresh plans on Sky News, Ms Miller maintained she respected the results of the EU referendum, which prompted Tom Harwood to say: “You’ve appeared on platforms with countless politicians in running your campaign Best for Britain.

“You are running Stop the Chaos. You’ve been involved in so many of these campaigns it’s extraordinary.

“The idea that you are not an anti-Brexit activist – Gina, I think people find this really patronising when you talk to people and you pretend to be such an impartial voice.”

The young Brexiteer, who ran the Student Leave campaign in the run-up to the 2016 referendum and now works as a reporter for website Guido Fawkes, continued: “You are clearly not an impartial voice.

“You believe leaving at all would cause us harm. That’s why you’ve been involved in these organisations to stop us leaving.”

Ms Miller, however, defended herself, insisting she had accepted the results of the referendum but wanted the legal process to be protected.

She said: “You should get on the record and see that after the referendum I said ‘we’re all Brexiteers now.’

“I left Best for Britain the day after the 2017 elections. I’m sorry but that’s not correct. I’m not part of – Best for Britain I left after the election.

“I’ve not been involved in any other campaign with any other MPs at all. I have a platform that is an information platform called End the Chaos. I have no conversations. I have not spoken to any MPs about this or about my case.”

The activist also revealed she had consulted legal advisors about the possibility of challenging Remainers attempts to prevent Brexit but ultimately she had no legal basis to launch a case. 

She told Mr Harwood: “They didn’t have anything that was legal to be challenged. 

“We have been looking at all the different procedures and there was a question about unusual conventions but then we spoke to parliamentary clerks and actually, it wasn’t against the law.

“It can only be something that is judiciable that you go to court for.”

Ms Miller also insisted she hoped her legal team will not have to bring the Government to court again over the potential prorogation of Parliament. 

Boris Johnson has not rejected suggestions he may try to suspend Parliament to avoid MPs from intervening to stop a no deal Brexit but the Tory leadership candidate has been warned he could still face opposition if he chose to do so.

Former Conservative prime minister Sir John Major told the BBC last week he would seek a judicial review in the courts if the new Prime Minister tried to suspend Parliament, describing such a move as “utterly and totally unacceptable”.

Sir John said: “You cannot and should not bypass Parliament in this fashion. I cannot imagine how anyone could conceivably think that is right.

“But, there is a secondary point to that as well. In order to close down Parliament, the Prime Minister would have to go to Her Majesty the Queen and ask for her permission to prorogue.

“If her First Minister asks for that permission, it is almost inconceivable the Queen will do anything other than grant it.”
