Treasury Secretary Steven Mnuchin on Wednesday told Congress that his department will miss its deadline for the release of President Trump’s tax returns.

In a letter to House Ways and Means Committee Chairman Richard Neal, Mnunchin didn’t say whether the Treasury Department will comply with congressional demands but said he still intends to review the request “carefully.”

On April 3, Neal formally requested that the IRS turn over six years of Trump’s tax returns in one week.

In his letter, Mnuchin added, “The legal implications of this request could affect protections for all Americans against politically-motivated disclosures of personal tax information, regardless of which party is in power.”

In his letter, Mnuchin wrote that given the “seriousness of these issues,” the Treasury Department is working with the Justice Department to ensure their eventual response is “fully consistent with the law and Constitution.”

Following the refusal, Neal said in a statement he “will consult with counsel and determine the appropriate response to the commissioner in the coming days.”

Trump told reporters earlier Wednesday he won’t release his taxes while under audit.

“I would love to give them, but I’m not going to do it while I’m under audit,” said Trump.
