Conservative talk radio host Larry Elder will appear on California's recall ballot this fall after a judge ruled Wednesday that he complied with the ballot requirements to run in the election aimed at unseating current Gov. Gavin Newsom, the Associated Press reports.

Why it matters: Elder's inclusion on the ballot brings the total number of candidates on the Sept. 14 recall ballot to 43, per Politico.

State of play: Elder was excluded from an initial listing of candidates last week after state officials alleged that Elder had submitted incomplete tax returns, per AP.

  • On Monday Elder filed a lawsuit to get on the ballot.
  • On Wednesday, Superior Court Judge Laurie M. Earl sided with Elder and noted that state officials shouldn't have required candidates to file tax returns "at all," reports Politico.

What they're saying: Elder sent out a flurry of tweets following the decision, including one saying, "This isn’t just a victory for me, but a victory for the people of California."
